1. Introduction & Acceptance

These Terms of Service ("Terms") govern your access to and use of the PromptCraft application and website (collectively, the "Service"). The Service is provided by Marviy Pte Ltd ("Company", "we", "us", or "our"), a company incorporated in the Republic of Singapore.

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Account Registration

To access certain features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access to or use of your account
  • Accept responsibility for all activities that occur under your account

Accounts are limited to one per person and are non-transferable. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

3. Service Description

PromptCraft provides AI prompt education, including interactive lessons, a multi-model prompt playground, prompt analysis tools, and related features designed to help users improve their ability to work effectively with AI models.

The Service integrates with third-party AI models, including but not limited to Claude by Anthropic, ChatGPT by OpenAI, and Gemini by Google. We do not control these third-party services and do not guarantee the accuracy, completeness, or reliability of any AI-generated outputs.

Features and content may change over time. We may modify, suspend, or discontinue features at any time with reasonable notice to affected users.

4. Subscriptions & Payments

The Service offers a free tier with limited features and paid subscription plans (Pro Monthly, Pro Annual, and Teams) with expanded access.

  • Paid subscriptions are billed through the Apple App Store, Google Play Store, or our website, depending on where you subscribe.
  • Prices are as listed at the time of purchase. We may change prices with at least 30 days' notice; price changes will not affect your current billing period.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
  • Refunds for app store purchases are handled per the policies of the applicable app store. For direct web subscriptions, refund requests made within 14 days of initial purchase will be considered on a case-by-case basis.
  • All prices are in USD unless otherwise stated.
  • Applicable taxes (including Singapore GST where relevant) may apply and will be shown at checkout.

5. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, abusive, defamatory, or infringing content
  • Attempt to reverse-engineer, decompile, scrape, or exploit the Service
  • Circumvent usage limits, rate limits, or access controls
  • Resell or redistribute access to the Service without our written authorization
  • Use automated tools, bots, or scrapers to access the Service
  • Violate the acceptable use policies of integrated third-party AI providers
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate any person or entity, or misrepresent your affiliation

We reserve the right to suspend or terminate your access for violations of this section.

6. Intellectual Property

All Service content, design, code, branding, lesson materials, frameworks, and educational content are owned by Marviy Pte Ltd or its licensors and are protected by intellectual property laws. "PromptCraft" and associated logos are trademarks of Marviy Pte Ltd.

Your content: You retain ownership of the prompts you create and the outputs you generate through the Service. You grant Marviy Pte Ltd a limited, non-exclusive, royalty-free license to process your inputs solely to provide and operate the Service. We do not claim ownership of your content.

Lesson content, frameworks, and educational materials provided through the Service may not be reproduced, distributed, or used commercially without our prior written permission.

7. Third-Party Services

The Service relies on third-party AI model providers to deliver core functionality. Your use of these features is also subject to the terms and policies of the respective providers:

8. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing:

  • We do not warrant that AI outputs will be accurate, appropriate, complete, or fit for any particular purpose.
  • We are not responsible for decisions or actions taken based on AI-generated content.
  • We do not guarantee uninterrupted or error-free operation of the Service.
  • We disclaim liability for any downtime, data loss, or service interruptions.

9. Limitation of Liability

To the maximum extent permitted by the laws of the Republic of Singapore, Marviy Pte Ltd's total aggregate liability to you for any and all claims arising out of or related to the Service shall not exceed the total amount paid by you to Marviy Pte Ltd in the twelve (12) months immediately preceding the event giving rise to the claim.

In no event shall Marviy Pte Ltd be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of the theory of liability.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Marviy Pte Ltd, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your infringement of any third-party rights
  • Content you submit, post, or generate through the Service

11. Termination

You may terminate your account at any time through the account settings or by contacting us.

We may suspend or terminate your account and access to the Service at any time, with or without cause, including for violations of these Terms. We will make reasonable efforts to notify you of the reason for suspension or termination.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including but not limited to intellectual property rights, limitation of liability, indemnification, and governing law.

12. Changes to Terms

We may update these Terms from time to time to reflect changes in the Service, our practices, or applicable law.

Material changes will be communicated via email or in-app notification at least 14 days before taking effect. The "Last updated" date at the top of this page will reflect the most recent revision.

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation between the parties. If negotiation fails to resolve the dispute within 30 days, the dispute shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre ("SIAC") in accordance with its prevailing rules.

  • The seat of arbitration shall be Singapore.
  • The language of arbitration shall be English.
  • The tribunal shall consist of a sole arbitrator.

14. General Provisions

  • Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Entire Agreement: These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Marviy Pte Ltd regarding the Service.
  • No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
  • Assignment: We may assign our rights and obligations under these Terms without restriction. You may not assign your rights or obligations without our prior written consent.
